Preamble: With the rise of victim-based crimes it’s only fair that the victims of these crimes should get compensation.
1. Short Title
(a) This bill should be known as the Victim Compensation Act
2. Definitions
(a) A “Victim” is a person that has had a crime committed against their person or their property.
(b) A “Criminal” is a person who has been charged and convicted of a crime and made to pay a fine or jail time for said crime
(c) “Property” should be defined as any land or item a person may own.
3. Compensation
(a) When a crime is committed against a victim, a charge is to be filed by the victim using either /911 or /911report. Any evidence for this crime must be submitted to the Ministry of Justice promptly.
(b) After a charge is filed, a victim can then go and file a compensation request with the Ministry of Justice. Any evidence relevant to the crime against the victim they are claiming compensation for must be submitted with this request.
i To meet the necessary requirements, the following is required for a request:
(1) A warrant was filed for the crime in-game, through an autogenerated /911 report or a manual /911report.
(2) Any evidence the victim has to prove the specific crime occurred, that they wish to be compensated for. Autogenerated warrants count as evidence.
ii The Ministry of Justice shall be empowered to review and evaluate all compensation requests. The Ministry is empowered to deny compensation requests if it feels there is not enough evidence to support a victim's claim.
(c) Should a request be valid, the victim should receive money as compensation.
i. For murder, the compensation shall be $150 per murder charge.
ii. For assault, the compensation should be $25 per assault charge.
iii. For threats of harm, the compensation should be $20 per threats of harm charge.
iv. For theft, the compensation should be $50 per theft charge, as well as restitution of stolen goods.
v. For attempted theft, the compensation should be $25 per attempted theft charge.
vi. For identity theft, the compensation should be $250 per identity theft charge.
vii. For trespassing, the compensation should be $25 dollars per trespassing charge.
viii. For AWS abuse, the compensation should be $150 per AWS abuse charge IF injury or death can be proven for this charge.
ix. For vandalism, the compensation should be $50 per vandalism charge.
(d) The Ministry of Justice has one week to review and reply to a compensation request, before legal action can be leveled against them for failure to respond.
(e) Should a compensation request be approved, the Ministry is expected to give the compensation within the following 72 hours.
4. Victim of Felonies
(a) If a victim of a felony charge were to come forth with evidence for a felony, the ministry of justice, the victim must wait until after the related criminal trial is completed, with 25% of the fine taken for the felony given as compensation.
5. Fraudulent Compensation Requests
(a) If a person is found to be making fake or fraudulent compensation requests in an effort to scam or otherwise take money from the government, the following system should be applied.
i. First offense: A denial of the request
ii. Second Offense: A denial of the request and a warning against fraudulent compensation requests
iii. Subsequent Offenses: A denial of the request, a warning, and a $500 fine.
(b) Should a request be approved, and later found to be a fraudulent request a criminal fraud charge may be leveled unless all compensation is returned.
Enactment: This Act comes into force immediately upon passage
