Act

Preamble: This bill aims to combine and simplify the rules surrounding Parliamentary Activity Requirements and Absences.

1. Authorship:
(a) This bill is heavily inspired by, and features content from the Active Parliament Act, written by Tracy Music, and its amending acts written by Iturgen Bolir and Nanicholls Nanicholls.

2. Repeals:
(a) This Act repeals the Active Parliament Act, and the Parliamentary Leave of Absence Act.

3. Minimum Activity Requirement:
(a) All Members of Parliament (MPs) must maintain a minimum level of active playtime.
(i) The minimum level will be set at four hours of active playtime.

4. Enforcement:
(a) The Presiding Office shall review the Active Playtime of all MPs weekly.
(b) Each time a Member of Parliament fails to reach the required Active Playtime, the MP will be issued an activity violation by the Presiding Office.
(i) All Activity Violations must be published
(c) All Activity Violations will be invalidated at the moment Parliament is dissolved.
(d) An MPs first and second activity violations shall count as warnings
(i) First warnings only can be removed by a supermajority of the house if the MP hit at least 75% of the Minimum Playtime Requirement and can evidence that the remaining time was spent on Parliamentary or Ministerial duties.
(e) An MPs third activity violation shall initiate a vote of on whether to expel the MP from Parliament. MPs may not vote on their own expulsion.
(f) A fourth activity violation will automatically expel the MP from Parliament.

5. Leave of Absence:
(a) MPs who take a MoSS Leave of Absence are exempted from that weeks activity requirements.
(b) These MPs are suspended from the house for the length of their LOA, or 7 days; whichever period is longer.
(i) Whilst suspended, MPs may not participate in debates or votes; with the exception of VONCs.
(ii) Suspensions can be ended early if the LOA is retracted, provided 7 days have passed.

(c) Each Leave of Absence is invalid if a public announcement of the LOA is not made.
(i) This announcement may be made by the MP or the Presiding Office.

6. Speakers Leave of Absence:
(a) If the Speaker desires to take a leave of absence, they must seek approval from parliament through a motion, requiring a simple majority to pass.
(i) This motion may not be called if no suitable deputy has been appointed to oversee the Speakers duties.

7. Proxy Votes:
(a) Whilst on Leave, members may appoint proxy voters to vote on their behalf.
(i) Proxy Voters must be members of Parliament, preferably within the same party where possible.
(ii) Members must provide written consent before being officially acknowledged as the official proxy voter.
(iii) The proxy voter must submit their own vote and the proxy vote independently of each other.
(iv) The proxy vote must be cast in the same manner as the proxy MPs own vote.


8. Excessive Absences:
(a) Should an LOA cover more than two thirds of the remaining parliamentary term, the MP in question is instantly moved to their third activity violation and an expulsion vote shall occur.

Enactment: This act will take effect immediately upon assent.
