Summary Judgment​

The Greyline Ledger v. Azalea Isles

Position of the Plaintiff:​

  1. The Plaintiff made claims alleging the National News Safeguards Act to be partially unconstitutional and seeking declaratory judgment of unconstitutionality.
  2. The Plaintiff seeks the aforementioned declaratory judgment and legal damages.

Position of the Defendant:​

  1. The Executive branch, after filing an answer to the complaint in opposition to Plaintiff's claims, changed course by declining to defend the State in this case and assenting to a Motion for Summary Judgment request by the Plaintiff.
  2. The Legislative branch declined to send a representative to defend the State in this case.

Court Opinion:​

  1. Given that Parliament and the Crown have fully repealed the contested Act of Parliament, the matter of alleged unconstitutionality is moot and the Court will not rule on it.
  2. Given that neither the Executive nor the Legislative wish to defend the State in this case, and the Executive has assented to a Motion for Summary Judgment, the Court is willing to grant reasonable legal damages to the Plaintiff, under the Damages Reform Act.

Decision:​

The Azalea Isles District Court hereby rules in favor of the Plaintiff in part, and grants the following relief:
  1. Legal Damages in the amount of $1000, for the lawyer work performed by Plaintiff's Counsel, to be paid out to Mr. Lyon within 7 days. The Court trusts that Mr. Lyon can forward the funds to the Plaintiff, if appropriate.
Both parties are informed that they have one week, beginning with this Summary Judgment, to seek appeal with the Supreme Court, if they wish.

The Court thanks both parties for their time. This trial is concluded.
