in your actions within the department have you ever entered private property with only an arrest warrant?

Aeronox4
As a member of the farm has police entered the farm more than once searching for Plaintiff? and if yes have they ever done so with a search warrant?

BezzerGeezer
Is plaintiff a member of the farm and worker within it?
Did you ever give permission to officers to enter the farm?

Anthony.org
As a worker in the farm. would you consider it to be in plain view?

To my knowledge, the police have entered the farm several times searching for Plaintiff. The last such event to happen was less than a week ago on November 22nd. At that time, I asked if they had a search warrant. They said they only had an arrest warrant. To my knowledge, they have never possessed a search warrant when entering the farm to search for Plaintiff.

No, the front of the property has a tree line that makes it near impossible to see into the farm. Despite this police and other players trespass onto the property nearly once a day

The Witness cannot know whether or not the police have never possessed a search warrant for the farm unless they had been online 24/7 which I can hardly imagine.

These questions and answers do not aim to expand our knowledge of this specific case but refer to other situations. I wish that the Plaintiff only refers to the situation brought up in the case file.

Objection, Your Honour, Speculation and Improper Opinion

The Plaintiff should merely try to gain facts from witnesses and not lead them to speculate about things, the same applies to the witness. Whether or not the property is or is not in plain view has to be decided by the judge and not by a witness. The answer should only contain a description of the property.

Is it department policy to interpret arrest warrants to allow for the entering of private property?
There has never been an official announcement to any department of the MoJ concerning an interpretation of this case.

When does the MOJ request Search warrants?
When the law explicitly requires us to do that.

Whats the MOJs definiton of the word Pursuit?
Pursuit is only mentioned in the police training guide. Officers pursue suspects after they are not willing to come to the police station volountarily.

When you entered the property did you ask for permission from MR BezzerGezzer
No I did not. To my info, you had a warrant, and I believe there was one or two officers already on scene before I arrived
Is it department policy to enter private property with an arrest warrant?
To my knowledge, the property the arrest was made on wasn't even yours, you don't own it

And to answer your repeat of questions:
Why did you enter the farm that day?
What where you doing at the farm that day?
Again, you had a warrant and there were one or two officers already on scene

Although I sadly do not remember who the officers were

The first objection is overruled. Search warrants require a judge’s approval, so such request would be publicly accessible.

The second objection is sustained, while this case deals with alleged concerns of warrantless entry, I ask questions are related to the original specific example brought up in the case file. Other instances were not originally brought up, and such testimony has no bearing on the original event mentioned.

Speculation is sustained in part. The answer contained a description of the property, but the phrase “makes it near impossible to see” ventures into the realm of speculation in relation to all potential observers.

Objection, Your Honour, Repetitive

This question was already directed towards RealHanuta, who answered it.

Objection is overruled, the Court will allow the similar question to be asked.

Motion to compel
Your Honor he has not answered my second question.

Accepted. The Court asks Mr. Emerald to please answer the question.

@EmeraldMXR

Motion to compel
Your Honor, he has not answered the first question

Motion is denied, the Court finds this answer to be acceptable.

Mr. Geezer, you still need to answer the Plaintiff’s questions. Failure to respond within 48 hours may result in contempt of court charges.

Is it department policy to enter private property with an arrest warrant?
In Azalea Isle Criminal Code section 11 (d) (iv), it states "(d) The Ministry of Justice must obtain a warrant before entering or searching private property, except in the following instances: (iv) When pursuing a suspect who has fled into the property"
One or two officers that were already there when I arrived, meaning that the plantiff had fled into the property when spotted and chased by officers
