BILL TO
Empower Law Enforcement Officers, Protect Incarcerated Lives, and Amend the New Criminal Code Act​

Preamble: This Act aims to mandate clear operational boundaries for Ministry of Justice personnel, to establish enforcement mechanisms for accountability, and to amend the rules of engagement to allow for expanded citizen oversight and property defense.

Recognizing that public trust is essential for a functioning civil society; and seeking to eliminate arbitrary exercises of authority that hinder regional peace and security, this Act mandates basic legal boundaries for all state-sanctioned enforcement while providing the citizenry with robust protections for life and estate.

Additionally, given recent studies showcasing the a significantly high mortality rate of incarcerated citizens, prison sentences for felonies have been rebalanced to be capped at 30 minutes, with a large fine to be paid for the remaining balance of the sentence if the jail time exceeds limits.

1. Short Title
(a) This bill shall be referred to as the “Law Enforcement Improvement Act"
(b) This bill is authored by Lil Digi.

2. Amendments to Punishments in the New Criminal Crackdown Act
The following fines and jail time will be amended in the following sections of the New Criminal Code Act

(a) Murder
(ii) Penalty: Dependent on repeat offenses
(1) First Offense: 10 minutes jail time; $300 fine
(2) Second Offense: 20 15 minute jail time; $600 fine
(3) Third Offense: 40 20 minute jail time; $1200 $900 fine
(4) Subsequent Offenses: 60 20 minutes jail time; $3000 $1500 fine

(b) Mass Murder
(ii) Penalty: Dependent on repeat offenses
(1) First Offense: 10 minutes jail time; $300 fine per murder
(2) Second Offense: 20 minute jail time; $600 fine per murder
(3) Third Offense: 40 30 minute Jail time; $1200 $900 fine per murder
(4) Subsequent Offenses: 60 30 minutes jail time; $3000 $1500 fine per murder
(iii) A person commits an offense if the person:
(1) commits 4 or more instances of Murder within a 24 12 hour period

(c) Assault
(ii) Penalty: Dependent on repeat offenses
(1) First Offense: 5 minutes jail time; $25 fine
(2) Second Offense: 10 minute jail time; $50 fine
(3) Third Offense: 15 10 minute jail time; $125 fine
(4) Subsequent Offenses: 15 minute jail time; $250 fine

(d) Identity Theft
(ii) Penalty:
(1) First Offense: Warning; immediate Change change to untaken Name name
(2) Second Offense: $500 fine; immediate Change change to untaken Name name
(3) Subsequent Offenses: 10 minutes jail time 30min Jail; $2500 $1000; immediate Change change to untaken Name name

(e) Bank Robbery
(ii) Penalty: Dependent on repeat offenses
(1) First Offense: 30 10 minutes jail time; $1000 fine; full restitution of stolen assets
(2) Second Offense: 45 15 minute jail time; $2500 fine; full restitution of stolen assets
(3) Subsequent Offenses: 60 25 minutes jail time; $5000 fine; full restitution of stolen assets

(f) Larceny
(ii) Penalty: 30 15 minutes jail time; $1000 fine; restitution of taken property

(g) Obstruction of Justice
(ii) Penalty: 30 15 minutes jail time; $500 fine

(h) Corruption
(ii) Penalty: 45 20 minutes jail time; Up to a $50,000 fine at the discretion of the judiciary; restitution of all gains from corruption.

(i) Government Bribery
(ii) Penalty: 45 20 minutes jail time; Up to a $50,000 fine at the discretion of the judiciary;

(j) Treason
(ii) Penalty: 45 20 minutes jail time; Up to a $50,000 fine at the discretion of the judiciary; ban from all government jobs for 4 months.

(k) Impersonation of a Government Official
(ii) Penalty : 30 15 minutes jail time; $1,000 fine

(l) Jailbreak
(ii) Penalty : 30 15 minutes jail time; $1000 fine

(m) Witness Tampering
(ii) Penalty : 30 15 minutes jail time; $1,000 fine minimum; $10,000 fine maximum

(n/) Selling of Prohibited Items
(ii) Penalty: 30 15 minutes jail time; $1000 fine; confiscation

(o) Trafficking of Prohibited Items
(ii) Penalty: 30 15 minutes jail time; $2000 fine; confiscation

(p) Coercive Behavior
(ii) Penalty: up to 30 minutes jail time; $1,000 minimum fine $10,000 maximum fine

(q) Electoral Dissuasion
(ii) Penalty: up to 30 minutes jail time; $1,000 minimum fine $10,000 maximum fine

(r) Gerrymandering
(ii) Penalty: up to 30 45 minutes jail time; $5,000 fine minimum; $10,000 fine maximum

3. Additions to the New Criminal Code Act

13. Engagement Doctrines

(a) Qualified Immunity Doctrine
(i) The Ministry of Justice and Ministry of Justice-employed law enforcement officers possess limited immunity from immediate criminal prosecution or administrative demotion while actively performing their duties provided their actions align with established, internal Ministry of Justice policy and do not infringe on fundamental protections granted by the Constitution of the Azalea Isles.

(ii) Ministry of Justice-employed law enforcement officers are authorized to utilize lethal force and execute an immediate Kill on Sight (KOS) order upon directly witnessing an active felony or violent misdemeanor being committed by a suspect. Documented visual confirmation of the offense by an officer grants immediate authorization to neutralize the target on sight, bypassing any requirement for applicable internal MOJ policies that may include but are not limited to verbal warnings, de-escalation tactics, or attempts at physical detention. To maintain public trust and operational integrity, this authorization is strictly restricted by the following boundaries:
(1) Lethal force is strictly prohibited if the witnessed crime is a nonviolent misdemeanor or non-violent civil infraction. Officers must utilize standard MOJ detention protocols for minor offenses.
(2) The officer must be a direct eye-witness to the active crime itself. Officers are strictly forbidden from executing a Kill on Sight order based on text-based criminal alerts, criminal history, or circumstantial evidence after the crime has already concluded.
(3) If the suspect completely halts their criminal activity and/or signals full compliance before lethal force is applied, the authorization for Kill on Sight is immediately voided, and officers must revert to standard MOJ arrest procedures

(iii) An officer’s immunity is immediately voided for a specific individual action, rendering them subject to appropriate charges, demotion, or litigation, if they commit any of the following violations:

(1) Unlawful Arrest or Search: Initiating an arrest, detention, or property search without established probable cause, active pursuit, or a valid judicial warrant.
(2) Collusion and Corruption: Engaging in bribery, leaking department communication, or providing tactical assistance, equipment, or immunity to known criminal entities.
(3) Unauthorized Use of Force: Deploying non-lethal or lethal force against an individual who is already restrained, fully compliant, or poses no immediate threat to life or property.
(4) Misappropriation of MOJ Property: Deploying Ministry of Justice tools for personal use or while off-duty.
(5) The individual retains immunity for actions taken that were not subject to the above listed violations.

(iv) The Ministry of Justice has legal immunity for all properly executed KOS actions.
(1) This immunity remains subject to judicial review, but the burden lies on the Plaintiff to prove, through a preponderance of the evidence, that the Ministry’s KOS authorization was invalid. This may mean not meeting the thresholds of Section 13(a)ii and its subsections, or that a violation was committed under Section 13(a)iii.
(2) If a ruling is returned, through trial, that the Ministry’s immunity does not apply to a specific instance, damages are not assumed and must be proven.

(b) Property Protection Doctrine

(i) Any lawful citizen or property owner is authorized to utilize proportional force, up to and including lethal force, to defend their designated property (including owned real estate, businesses, and personal vehicles) against active, unauthorized intrusion, burglary, or threats of harm

(ii) A citizen who is lawfully present on their owned or rented property has no duty to retreat from an intruder or attacker. They hold the legal right to stand their ground and meet force with force if they reasonably believe it is necessary to prevent a felony or to protect themselves, their property, or others from imminent harm

(iii) Limitations for Fairness: To prevent abuse of this doctrine, the protections of this section are strictly limited by the following conditions:
1. The Intrusion Requirement: Force may only be deployed if the intruder has actively breached the property line or is actively destroying/stealing property. Brandishing or firing at individuals who are merely standing on public sidewalks or adjacent property is strictly prohibited.
2. The Surrender Exception: If an intruder completely ceases their hostile actions, drops any weapons, and attempts to retreat from the property or surrender, the authorization for immediate lethal force is voided. The property owner must allow them to flee or detain them without further violence until Ministry of Justice officers arrive.
3. The Government Exception: This doctrine does not apply against Ministry of Justice officers who are executing a legally authorized warrant, conducting an active pursuit, or responding to an emergency, provided the officers are clearly identifying themselves as law enforcement.


4. Amendments to other parts of the New Criminal Code Act
(a) Addition to “3. Key Definitions”
(n/) “Violent Misdemeanor” shall be defined as a crime classified in the ‘Misdemeanor’ category that includes the harm or threat of harm of another citizen.

(b) Addition to “12. Enforcement and Prosecution Procedures”
(e) The maximum duration for consecutive jail sentences stemming from a single arrest shall be strictly capped at 30 minutes. In the event that an offender's combined criminal charges warrant a sentence surpassing this 30-minute limitation, the remaining balance of the sentence shall be converted into a mandatory fine levied against the offender at a rate of $150 per minute.

5. Repealing the Protect the People Act
(a) The Protect the People Act is hereby repealed.

6. Repealing the Police Brutality Act
(a) The Police Brutality Act is hereby repealed.

Enactment: This Act comes into force immediately upon passage.
