1. Name and purpose
(a) This Ordinance may be cited as the Salmonberry Salary and Compensation Ordinance.
(b) This Ordinance governs compensation paid by the Free District of Salmonberry. Offices and departments have the meanings given by the Salmonberry Establishment Ordinance.
2. Fixed salaries
(a) The following base salaries shall be payable for each calendar month, subject to sections 4 and 5:
(i) Commissioner: $12,500.
(ii) Constable: $12,500.
(iii) Health Director: $12,500.
(iv) Mayor: $12,500.
(v) Advisory Council Member: $4,000.
(b) A person lawfully holding more than one of these offices shall receive the salary for each office they hold, except that the Commissioner, Constable, Health Director, and Mayor shall not be additionally paid the salary of an Advisory Council member. The salary for each office shall be calculated separately. No salary is payable for a vacant office, and assisting an officeholder does not itself constitute appointment to that office.
(c) These base salaries may be changed only by ordinance or other superior law. However, a mayoral order may supplement them with a bonus, stipend or allowance for good performance in the same office. Orders under this subsection shall comply with section 3(b) and (c).
3. Compensation by mayoral order
(a) Within compensation allocations established by local ordinance, the Mayor may by mayoral order establish, amend or discontinue monthly or weekly salaries, stipends and recurring allowances for other district positions or assigned duties.
(b) Each order shall state the positions or duties covered, the amount payable, whether the payment is one-time, monthly, or weekly, its effective date, any conditions for earning the payment, the payment deadline for a one-time payment, and the ordinance allocation from which it is payable. An order cannot create or increase a budget allocation.
(c) Orders shall be signed and published in the District’s official register before taking effect, except for September compensation expressly authorized by section 5. Changes shall be clearly communicated to affected employees and shall not reduce compensation already earned.
(d) Fixing compensation does not make an appointment or transfer hiring powers. The Constable, Health Director and other officials retain the powers and discretion assigned to them by national law.
4. Calculation and payment
(a) From 1 October 2026, compensation shall accrue from the date a person lawfully takes up the office or employment and begins its duties until their service ends. The first and last days of service count as days served.
(b) For part of a calendar month, payment shall equal the monthly rate multiplied by the number of calendar days served, divided by the number of calendar days in that month. For part of a week, payment shall equal the weekly rate multiplied by the number of calendar days served, divided by seven. A week runs from Monday through Sunday.
(c) Where a lawful rate change takes effect during a period, each portion shall be calculated at its applicable rate. The total due for each position and pay period shall be rounded to the nearest cent. Calendar days, rather than hours logged into the server, shall govern proration.
(d) Monthly compensation shall be paid within seven days after the month ends; weekly compensation shall be paid within seven days after the week ends. The Mayor may direct weekly installments of a monthly salary, provided the total is reconciled to that calendar month’s entitlement by its payment deadline. Changing payment frequency does not change the salary rate.
5. September 2026 commencement payments
(a) To support the establishment of the District, a person who lawfully holds a paid district position and serves in it during September 2026 shall receive the full salary established for that month, without proration. This includes persons who begin service partway through September and service before this Ordinance is published.
(b) For the offices in section 2, the September payment shall be the full monthly amount listed there. For other positions, a mayoral order may expressly grant September compensation and shall state the rate applicable to that payment. A weekly rate shall be converted to a full September payment by multiplying it by thirty and dividing by seven, rounded to the nearest cent.
(c) September compensation shall be paid within seven days after the later of 30 September 2026 or publication of the instrument establishing it. This section does not authorize a reduction or recovery of compensation already lawfully earned.
(d) For a weekly period crossing 1 October 2026, September days shall be paid only under this section and October days shall be calculated under section 4.
6. Expenses and financial administration
(a) The Mayor shall administer payroll through the business account "District2" and may delegate its processing under section 2 of the Salmonberry Establishment Ordinance.
(b) Reasonable expenses actually incurred for authorized district business may be reimbursed upon evidence of the expense and its official purpose, within an allocation established by ordinance. An expense already reimbursed from another source shall not be paid twice.
(c) This Ordinance authorizes expenditure for the base salaries, bonuses, and other supplemental compensation provided under section 2. Allocations for other compensation and expenses shall be established by local ordinance. Payments shall remain within lawfully available district funding and any applicable conditions on that funding.
(d) The Mayor shall arrange the budget requests required by national law and retain records of appointments, applicable rates, calculations, payments, expenses and outstanding balances. A funding shortfall does not extinguish compensation already earned; the Mayor shall record unpaid amounts and seek the necessary lawful funding.
7. Enactment
This Ordinance comes into force immediately upon its publication. Section 5 expressly governs compensation for September 2026; the proration rules in section 4 apply from 1 October 2026.
