Type: Act of Parliament
Preamble: The active players of Azalea Isles do not currently have an established right to collective industrial action. This bill seeks to establish the parameters around which individuals may strike and how employers may interact with striking employees.
1. Conflicts
(a) In the event that any portion of this Act conflicts with any prior Act or Government policy, the contents of this Act shall supersede any such conflict.
(b) In the event that any future legislation conflicts with this Act, the contents of the new Act shall supersede any such conflict.
(c) Only the conflicting portions of legislation/policy shall be overwritten, any non-conflicting portions shall remain in effect.
(d) In the event that any of the contents of this Act are found to be unconstitutional, only the unconstitutional sections shall be stricken and the rest shall remain in effect.
2. Definitions
(a) Strike: A concerted cessation of work by employees to compel an employer to address grievances.
(b) Lawful Strike: A strike conducted in compliance with Sections 3(a)-(c) of this Act.
(c) Employer: Any entity or player employing workers within Azalea Isles.
(d) Employee: A citizen engaged in labor under contractual or informal agreement.
3. Rights and Obligations of Employees
(a) Any citizen employee may strike provided:
(i) The strike has a clear, relevant, and realistic goal (e.g., wage disputes, unsafe working conditions).
(ii) At least 24 hours’ notice is given to the employer, unless exigent circumstances exist (e.g., workplace hazards).
(b) Employees may form labor unions or guilds but are not required to do so.
(c) Prohibited Actions: Striking employees shall not:
(i) Engage in violence or property destruction.
(ii) Strike during pre-negotiated arbitration processes.
4. Rights and Obligations of Employers
(a) Employers shall not retaliate against employees for lawful strikes (e.g., termination, demotion).
(b) Employers may hire temporary replacements during strikes but must prioritize reinstating original employees post-strike.
(c) Employers must continue benefits (e.g., salary, housing, tool access) during lawful strikes.
5. Dispute Resolution
(a) An employer alleging an unlawful strike may file a lawsuit in the Azalea Isles Court.
(b) Upon filing, the employer may:
(i) Withhold salaries but owe back pay + 50% if the strike is deemed lawful.
(ii) Continue salaries but seek full repayment if the strike is deemed unlawful.
(c) Burden of Proof: Employers must demonstrate clear evidence of illegality (e.g., violence, lack of notice).
Enactment: This Act comes into force immediately upon passage
