Protect tenants and regulate evictions

1. Short Title and Enactment​

(a) This bill shall be referred to as the "Rental Regulations Act".
(b) This Act comes into force immediately upon passage.

2. Rental Properties​

(a) All properties which can be rented freely through the realty market, or that are privately rented through contract are subject to this Act.

3. Tenant Protections​

(a) Any individual renting a property is subject to these protections.
(b) Landlords may not obstruct, destroy, or otherwise modify a rented region without consent from the tenant.
(c) All rules for the rental property must be posted in a conspicuous and accessible place.
(d) Rentals must remain physically accessible in the event of a power outage.

4. Evictions​

(a) Landlords may apply to the Ministry of Urban Development to evict tenants immediately with just cause.
(b) The Ministry of Urban Development is granted the power to adjudicate rental disputes, grant evictions and execute evictions.
(i) Once an eviction application is opened, the Ministry of Urban Development will have 72 hours to issue a decision.​
(ii) Any landlord found to have lied to the Ministry in order to secure an illegal eviction of a tenant will be liable for 5 times the amount of rent of the full rental period for the evicted property.​
(iii) The Ministry of Urban Development shall not be liable for wrongful evictions caused by Section 4(b)(ii).​
(c) Just causes for eviction shall include:
(i) Legal death,​
(ii) Rule violations,​
(iii) Destruction of property,​
(iv) Failure To Vacate; and​
(v) Failure to pay rent.​

5. Notice To Vacate​

(a) Where no other rental contract exists that would conflict with this provision, a landlord may give a 30-day notice to vacate to their tenant.
(i) The landlord must refund the tenant the full amount of the remaining paid rent, plus an additional rental period’s rent.​
(b) A tenant receiving this notice must vacate the property before the end of the notice period.
(i) Any tenant found to still be occupying a property after the end of the notice period will be subject to eviction per Section 4 of this Act.​

6. Repeals​

(a) The Protection of Tenants Act shall be repealed in full.
(b) The Landlord's Rights and Regulations Act shall be repealed in full.
