Clarify the Prime Minister’s Executive Powers​

1. Short Title
(a) This bill shall be referred to as the "Prime Minister Powers Act".
(b) This bill was authored by Lysander Lyon.

2. Powers of the Prime Minister
(a) The Prime Minister shall be granted the executive order power. Executive orders do not have the power to override existing statutes. They are used to direct Ministries and government bodies to adopt specific policies, undertake certain actions, or cease undertaking certain actions.
(i) Executive orders carry the force of law, in absence of a statute to contradict them. They are not law, and are secondary to the law.
(ii) Government employees may be fired for noncompliance with an executive order.
(iii) Executive orders may be used to direct the military, making the Prime Minister in effect the ultimate Commander-in-Chief.

(b) The Prime Minister shall have the power to handle international trade using executive orders, as outlined below:
(i) The Prime Minister has the power to decide which foreign nations the Azalea Isles will engage in trade with. This means the Prime Minister may unilaterally close off trade, or open up trade, to other nations.
(ii) The Prime Minister may also regulate trade in part, banning specific foreign companies from doing business in or with the Azalea Isles.
(iii) The Prime Minister may ban the exports or imports of specific goods (or categories of goods), entirely or to/from specific nations.
(iv) The Prime Minister may levy tariffs on specific goods, categories of goods, on trade with specific companies or countries, or in general.

(c) The Prime Minister may levy other powers not expressly mentioned here that are held by Ministries and government agencies, through the use of executive orders.
(d) Members of Parliament may propose legislation to repeal an executive order. Legislation for this purpose would follow the normal legislative process.

3. War, Emergencies, and War Powers
(a) Only Parliament has the power to declare war, and war may only be declared through a majority of Members of Parliament voting in favor of a declaration of war. Declarations of war against a foreign nation may be proposed by anyone, but they must be proposed in legislative format, with the type being “Declaration of War” and must outline the nation(s) Azalea Isles is to declare war on, and the reasons for said war. Declarations of war will follow the normal legislative process.
(i) If war has not been declared against a nation, the Prime Minister may not engage in activities that could reasonably be considered an act of war, such as attacking other nation’s shipping lanes or launching strikes on their soil.
(b) The Prime Minister shall be imbued with the power to declare National Emergencies. A National Emergency may be declared only when the immediate safety and national security of the country is at risk; for example, intelligence has been received of an immediate attack on Azalean soil. Activities that would majorly harm or impact the Azalea Isles, or undermine its functioning, count as valid reason to declare a National Emergency.
(i) National Emergencies are intended to be used when events of major importance or with major potential could reasonably occur. This should be interpreted relatively broadly; attacks from a foreign nation, on Azalean soil or even on Azalean ships, would count. A minor protest would not.
(ii) Parliament shall immediately be convened for a vote on whether to uphold the National Emergency's validity or vote it down, based on simple majority vote, which shall end after 24 hours or after a majority consensus is reached, whichever is shorter.
(iii) A vote may be bypassed if the Prime Minister has written statements of support for the specific National Emergency from a majority of Parliament.

(c) Under a National Emergency, the Prime Minister may order offensive strikes that would otherwise be an act of war, if it is reasonably necessary for the immediate national security of the Azalea Isles. For example, a missile or air strike on an Aedoris port would be a prohibited act of war, unless a National Emergency was declared over credible intelligence that says the ships in that port are about to embark on an attack against the Isles.
(d) National Emergencies by default expire after 14 days. They may be renewed by the Prime Minister once, for a total of 28 days.
(e) A simple majority of Parliament may vote to end a National Emergency at any time, or extend a declared National Emergency by either a set amount of time or indefinitely.

Enactment: This Act comes into force immediately upon passage.
