Correct errors and resolve issues with the old identity theft act.
Preamble: This bill shall amend the New Criminal Code Act by illegalizing Identity Theft.
1. Naming and Author
(a) This bill shall be named "The Identity Theft Act"
(b) This bill was authored by Biscuit Cookie.
(c) Credits: Dogan Karaca, author of the original identity theft act.
2. Repeals
This bill shall repeal the Identity Theft Act in full.
3. Order of conduct
(a) A person makes a change to a name already taken by another person that isn’t legally dead.
(b) The legally undead person reports a violation to the ministry of justice.
(c) The original person is given $1,100 by the ministry of justice to cover the change to another name.
(d) The original person must comply with the ministry of justice’s order to change their name.
(d.i) If the person isn’t on a leave of absence through the ministry of social services they will have 1 week to change their name.
(d.ii) If the person is on a leave of absence through the ministry of social services, any money given by the Ministery of justice will be returned to the ministry of justice until the LOA is over.
(d.iii) If the person doesn’t change their name within the required time the Ministry of justice is allowed to take a $2,200 fine.
4. Amendments
(a) Section 4. of the NCCA shall be amended as following:
(i) (j) Identity Theft
(i) Offense Type: Misdemeanor
(ii) Penalty:
(1) First Offense: Warning; immediate Change to untaken name
(2) Second Offense: $500 fine; immediate Change to untaken name
(3) Subsequent Offenses: 30min Jail; $1500; immediate Change to untaken Name
(iii) A person commits an offense if the person:
(1) A person makes a change to a name already taken by another person that isn’t legally dead.
(2) Refer to the New Identity Theft Act’s Order of Conduct section for order in which conduct may be conducted.
Enactment: This Act comes into force immediately upon passage.
