Fix the New Criminal Code Act’s Definition of Murder​

Preamble: Currently, an individual may be charged with murder if they “[kill] another person without being consented or [kill] another person without it being the result of self-defense.” The word “or” is problematic. Someone may be charged with murder even in a case of self-defense because the initial aggressor probably did not consent; alternatively, someone may be charged with murder even if the victim consents if it is not also a case of self-defense. This bill seeks to remedy this issue.

1. Short Title
(a) This bill shall be named the “Murder Fix Amendment”.
(b) This bill was authored by Parry Apollo.

2. Amendment to the New Criminal Code Act
(a) Section 4(a)(iii) of the New Criminal Code Act shall be amended as follows:

(iii) A person commits an offense if the person:
(1) kills another person without being consented or; that person’s consent, except where the killing is the result of self-defense.
(2) kills another person without it being the result of self-defense.

Enactment: This Act comes into force immediately upon passage.
