Moratti Capital Holdings, Plaintiff

v.

pclipz, Defendant

Civil Complaint:
Plaintiff brings this action for breach of contract arising from Defendant's default on an Unsecured Revolving Credit Agreement (Ref: #P-001, executed 23 August 2026), under which Defendant borrowed A$2,000.00 principal at 3.5% weekly interest. Defendant remitted only A$485.00 in total before ceasing payment entirely, leaving A$1,815.00 outstanding.(Ref: #P-002)

Parties:
  1. Plaintiff: Moratti Capital Holdings, represented by Antonio Moratti (CEO)
  2. Defendant: Paper Clip (pclipz)
Factual Allegations:
  1. On 23 August 2026, Plaintiff and Defendant executed a valid Unsecured Revolving Credit Agreement (Ref #P-001) satisfying the Requirements of Agreement — offer, consideration (A$2,000.00 principal advanced), acceptance, and execution (both parties' signatures, dated 23 August 2026).
  2. Per Clause 1.1, the debt binds to Defendant's Minecraft UUID and is not discharged by character or account changes.
  3. Defendant made the following payments toward the debt, per Plaintiff's transaction ledger:
    1. 23/08/2026: $236.00 and $8.00 ($244.00 total)
    2. 30/08/2026: $1.00, $200.00, and $40.00 ($241.00 total)
    3. Total remitted: A$485.00
  4. Defendant made no further payments after 30 August 2026.
  5. Under Clause 4.2, failure to remit payment for more than seven (7) consecutive days constitutes default. As of the date of filing, Defendant has made no payment for approximately 23 consecutive days, well past the default threshold.
  6. From execution to the date of filing (30 days), accrued interest totals A$300.00 (A$10.00/day), bringing total obligations to A$2,300.00, against which A$485.00 has been credited, leaving A$1,815.00 outstanding.
  7. This is a Binding Agreement under the common law of Azalea Isles: the Agreement has not been fulfilled, contains no self-voiding clause, and Defendant has not raised any grounds (unconscionability, impossibility of performance, or otherwise) that would permit it to be voided.
Legal Claims:
  1. Material Breach — Defendant has deliberately failed to fulfill its payment obligations under Agreement #P-001 since 30 August 2026, constituting a Material Breach under the common law of Azalea Isles, entitling Plaintiff to enforcement of the Agreement's terms and an award of damages.
  2. Default under Clause 4.2 of the Agreement — non-payment for more than seven consecutive days constitutes an event of default entitling Plaintiff to the full outstanding balance.
Prayer for Relief:
  1. Judgment against Defendant for A$1,815.00, as Compensatory Damages equivalent to the proven, unpaid balance owed under Agreement #P-001 (outstanding principal and accrued interest through the date of filing).
  2. Authorization for asset seizure/liquidation under Clause 4.4 of the Agreement, escalated to Server Staff for enforcement, should Defendant fail to satisfy the judgment.

Verification:
I, Antonio Moratti, hereby affirm that the allegations in the complaint AND all subsequent statements made in court are true and correct to the best of the plaintiff's knowledge, information, and belief and that any falsehoods may bring the penalty of perjury.
