Type: Amendment to an Act of Parliament
Preamble: Written at the request of the Minister of Urban Development, this bill aims to loosen Industrial Inspection scheduling under the Industrial Regulation Act, from a strict monthly schedule, to a more needs-based approach. In avoiding unnecessary inspections, the burden on the rights and time of Property Owners is reduced, and the resources of the Ministry of Urban Development prudently conserved for more pressing or beneficial business.
1. Amendments to the Industrial Regulation Act, section §3 “Industrial Inspections”
(a) Inspectors shall conduct routine inspections of all industrial properties, except those held by the government.
(i) Inspections must shall occur once per month during the first week, regardless of the previous inspection date.
(ii) If a property fails inspection, a follow-up inspection must be scheduled within 3–7 days.
(iii) Only properties with an Property Owner are subject to inspection. If the owner is on LOA, any pending inspections must be completed within 3-7 days of their return.
(iv) The Property Owner may refuse entry to any inspector. Refusal of entry may result in a reduced score on the inspection, at MUD’s discretion.
(v) An inspection is complete once the MUD minister or a Deputy MUD minister has signed the industrial inspections.
(viii) Inspectors may only perform actions related to the inspection. Evidence of unrelated crimes discovered during an inspection is inadmissible to preserve inspection integrity.
(vi) The Minister of Urban Development may, at their discretion, waive all Industrial Inspections for the upcoming month via public announcement, if they determine that pollution levels in the Azalea Isles currently pose no significant cause for concern. This waiving must not be prior to the last 7 days of the preceding month and must not be after the initiation of the first Industrial Inspection for the relevant month. The Minister may not waive only some Industrial Inspections in this manner.
(vii) Parliament may, by simple majority resolution addressed to the Ministry of Urban Development, make a finding of concern regarding current pollution levels and order the Ministry to perform the next scheduled wave of Industrial Inspections. Such a resolution supersedes the Minister’s decision on whether to waive.
2. Amendments to the Industrial Regulation Act, section §6 “Custodian Duty”
(a) MUD must publish a public schedule of all routine property inspections for the first week of the month, including inspection dates, prior to conducting the first routine inspection. Failure to publish the schedule constitutes an offense; if not posted within 3 days, additional offenses will be issued every 3 days until compliance. The schedule must be posted at the earliest available opportunity. Offenses are reset each time a different MUD minister is appointed and at the beginning of each Parliamentary term.
(1) Penalty: Dependent on repeat offenses
(i) Any Offense: $500 fine issued to the MUD Minister;
(ii) Fifth Offense: Additionally, Parliament shall be notified about this dereliction of duty.
(ii) Fifth Offense: Parliament shall vote on the removal of the MUD Minister. If the vote passes, the Prime Minister shall appoint a successor.
(b) The Ministry of State is responsible for notifying Parliament and issuing fines to the MUD Minister.
(c) MUD is not required to publish schedules for months with properly waived inspections.
Enactment: This Act comes into force immediately upon passage and ratification.
