Establish Employee Rights and Protections Within Government Employment

Preamble:​

Whereas government employees dedicate their time and effort to serving the people and operating the government of Azalea Isles. Government employees deserve fair treatment, reasonable compensation, transparency, and protection from retaliation while performing their duties; Whereas employees should be able to report misconduct, provide feedback, and raise legitimate concerns without fear of punishment or harassment. Therefore, Parliament enacts this legislation to establish fundamental rights and protections for government employees.

1. Employee Rights​

(a) All government employees shall have the right to:
(i) Fair and reasonable compensation for work performed.
(ii) Clear information regarding their position, responsibilities, compensation, and expectations.
(iii) Fair and respectful treatment while performing their duties.
(iv) Raise concerns, provide feedback, or report misconduct without fear of retaliation.
(v) Reasonable consideration for real-life circumstances that temporarily affect their ability to participate.
(vi) Protection of personal information and employment records except where disclosure is required by law or court order.

2. Fair Employment Practices​

(a) Government employees shall be evaluated and disciplined based on their conduct, performance, and fulfillment of their responsibilities.
(i) Employees shall not be punished solely for making an honest mistake while acting in good faith.
(ii) Disciplinary action shall be reasonable and proportionate to the violation.
(iii) Employees shall be informed of serious allegations or disciplinary action against them and provided a reasonable opportunity to respond.
(iv) Personal disagreements, grudges, political disagreements, or criticism made in good faith shall not constitute sufficient grounds for disciplinary action.

3. Compensation and Transparency​

(a) Government positions that provide compensation shall have their pay and applicable requirements clearly established.
(i) Employees performing substantially similar duties shall receive equal compensation unless a legitimate reason exists for a difference.
(ii) Compensation that has been earned shall not be withheld as punishment unless expressly authorized by law or the terms of employment.
(iii) Any changes to an employee's compensation shall be communicated clearly and may not be made retroactively without lawful justification.

4. Protection Against Retaliation​

(a) No government official or employee shall retaliate against another employee for:
(i) Reporting suspected misconduct or violations of law.
(ii) Providing good-faith criticism or feedback.
(iii) Disagreeing with a government policy or decision respectfully.
(iv) Participating in an investigation, hearing, or judicial proceeding.
(v) Exercising any right established under this Act.
(b) Retaliation includes, but is not limited to:
(i) Unjustified termination, demotion, suspension, or removal.
(ii) Reduction or withholding of compensation.
(iii) Harassment, intimidation, threats, or discrimination.
(iv) Deliberately interfering with an employee's duties or opportunities.
(c) A person found liable for intentional retaliation may be subject to penalties or other remedies determined by the Judiciary.

5. Whistleblower Protections​

(a) Any government employee who reports suspected misconduct, corruption, abuse of authority, or violations of law in good faith shall be protected from retaliation.
(i) The identity of a whistleblower shall be kept confidential to the fullest extent permitted by law unless disclosure is required by a court.
(ii) A whistleblower shall not be punished merely because an investigation does not ultimately establish wrongdoing, provided the report was made in good faith.
(iii) Knowingly false reports made for the purpose of harming another employee shall not receive protection under this section.

6. Complaints and Judicial Recourse​

(a) A government employee who believes their rights under this Act have been violated may file a complaint with the Judiciary.
(i) The Judiciary shall have authority to review alleged violations of this Act and determine appropriate remedies.
(ii) The court may order reinstatement, restoration of compensation, damages, or other appropriate remedies when a violation is established.
(iii) A person found responsible for retaliation or intentional violation of this Act may be subject to additional penalties as determined by the court.

7. Good-Faith Government Service​

(a) Nothing in this Act shall prevent the government from disciplining, suspending, or removing an employee for legitimate misconduct, incompetence, inactivity, failure to perform assigned duties, or violation of law.
(i) This Act shall not protect an employee from legitimate disciplinary action merely because they claim the action is retaliation.
(ii) The purpose of this Act is to prevent abuse of authority while preserving the government's ability to maintain accountability and effective public service.

Enactment:​

This Act comes into force immediately upon passage.
