Enable Private Prosecution


Preamble: Give Azalean Citizens the right to bring forward criminal cases should the Ministry of Justice choose not to pursue.


1. Private Prosecution
(a) Private citizens may bring forward criminal cases.
(b) Citizens must have standing to bring forward a case.

(i) Citizens do not require any personal standing if the case is being brought against a Member of Parliament, a member of the Cabinet, or a Ministry Employee, in their official capacity.

2. Case Reclamation
(a) Judges must contact the Ministry of Justice during before private prosecution hearing to ensure the Ministry of Justice are not planning on bringing forward a case themselves.
(i) If the Ministry of Justice is planning to bring a case to court, they are given 14 days to bring the case forward.

(ii) If the Ministry of Justice fails to file a court case within 14 days, the private prosecution automatically resumes and the Ministry of Justice surrenders its right to participate in the hearing.

(iii) This 14-day period cannot be extended.

(iv) This 14-day period does not count toward the Statute of Limitations

Enactment: This Act comes into force immediately upon passage.
