Clarify and Establish Worker’s Rights​

1. Short Title
(a) This bill shall be referred to as the "Azalean Worker's Rights Act".
(b) This bill was authored by Lysander Lyon.

2. Union Formation
(a) Trade unions are unions formed for workers of a specific industry. Any individual working within this industry may choose to form a trade union.
(i) There may be no more than three trade unions registered for any one industry at any time.
(ii) Trade unions may not be registered for an industry with an in-game role, like the Miner role, by any individual who does not hold that role at the time of registering.

(b) Unions of must be registered with the Ministry of Economic Affairs, which shall set up a channel for registration. To register a union, an individual must submit proof of having the proper role in-game for registering a trade union, and a copy of the union’s bylaws.
(i) It must also have the signatures of three other individuals within that industry who are not the initial founder filing the paperwork, who will be joining the union. This requirement is waived if the trade union is to be in what the game classifies as a “profession”: lawyer, artist, hunter, and so on.
(c) Unions may not be formed for government jobs/employment.

3. Default Bylaws and Bylaw Rules
(a) If no bylaws are submitted, the default bylaws outlined in section <> will be used.
(b) Custom bylaws must have:
(i) A procedure for electing a President of the union, with the President serving a term of no longer than four months.
(ii) An Executive Committee with significant elected representation and individual terms for the elected positions of no longer than four months.
(iii) A set timeline for union conventions where voting can occur and union members can receive updates on the business of the union.
(iv) Failure to contain clauses that fulfill the standards outlined here will result in the denial of a union’s registration.

(c) The default bylaws for a union shall be as follows:
  1. If the union has fewer than 7 members, the union’s duties shall be fully executed by the President of the union, with no Executive Committee.
  2. The union shall otherwise have an Executive Committee of 5 individuals. The President shall automatically serve as the head of the Executive Committee, with the Treasurer and Policy Director elected by the union, and the Secretary and Vice President appointed by the President.
  3. While the union may coordinate and communicate regularly through a Discord, there shall be a monthly convention held for the purposes of conducting committee elections, handling resolutions, and other such union business as outlined on the agenda by the Secretary. The convention shall begin on the 10th day of each month, and end on the 20th day of the month, with the allowance for the closure of any voting that had started on or before the 20th.
  4. Elections shall begin on the 14th of the month, from among members who have declared their candidacy, and end on the 18th, with the prior officers serving out the entire convention and the new officers taking office on the 21st.
  5. The President shall be elected from among the union members to a three month term. If the elected individual is unable to fulfill their term, the Vice President shall assume the duties and responsibilities of the president, without gaining an extra vote on the Committee.
  6. The Treasurer and the Policy Director shall each serve a two month term, but staggered, such that the first term of the Policy Director shall be one month, and then two months every thereafter.
  7. Members of the union may submit questions to be answered during the convention, and resolutions to be brought to vote. Resolutions may be recommendations to the Executive Committee, which may pass with 50% + 1 of votes cast, or required actions (directives) that must pass with at least 60% of votes cast.
  8. The Executive Committee may pass rules, guidelines, policy, etc. on behalf of the union. Members may adjust policy through directives (60% requirement). A strike can only be called through an approved directive; the Executive Committee may propose a strike, but cannot call one without that membership vote.

4. Trade Union Powers
(a) Trade unions shall have the power to negotiate with employers on behalf of their workers regarding wages, working conditions, workplace procedures, and other relevant employment items.
(b) Trade unions shall have the power to set fees for membership and collect contributions.
(c) Trade unions may maintain a publicly visible price floor for goods within their industry.
(d) Trade unions shall have the power to go on strike and cease business with an employer.
(i) Company-provided benefits that are not explicitly required to do the job, such as housing, must continue to be provided by the employer to any striking employees.
(ii) The employer is not obligated to continue providing salary/payment to individuals on strike, or tools given to do the job (like pickaxes to miners on strike).
(iii) All strikes must have a specific, relevant, and named goal, such as a wage dispute, a specific working condition, etc.
(iv) The employer must receive at least 48 hours notice prior to any strike being actioned.

(e) Trade unions may take the actions necessary to incentivize union members to follow union directives, through reasonable fees for noncompliance or membership revocation.

5. Employment Freedoms
(a) Citizens of the Azalea Isles shall have employment freedom, and shall not be discriminated against on the basis of having or not having union membership.
(b) Unions may not require that an employer only hires members of their union, or only hires members of a union in general.
(c) Individuals may not be a member of more than one trade union for any one trade at any given time. This means a Miner must pick one mining union. They can, however, also be in an art union if they are also an Artist.

6. Employer Recourse
(a) Union strikes may not engage in violence or property destruction. Union strikes also may not occur during agreed-upon arbitration periods between the union and an employer, or during the initial 48 hour notice period.
(b) Employers may hire temporary workers not affiliated with the striking union to continue to operate the business.
(c) If an employer feels a strike is illegal due to violating the notice period, a strike pause agreed-upon under arbitration / discussion between the union and employer, due to violence and/or property destruction, or due to being unspecific, they may sue in court.

7. Parliamentary Override
(a) Parliament may, for clearly articulated national security reasons, vote to suspend a strike (for a set period of time or indefinitely) via resolution. The strike is legally required to end if suspended by a majority vote of Parliament.

Enactment: This Act comes into force two weeks after passage.
