A Bill to Establish a System to Report Police Misconduct​


Preamble
In the streets of Azalea, there is no place for criminal misconduct including that by the police. If such a misbehaviour
is noticed, citizens must have the possibility to report police officers to the Ministry of Justice.

1. Structure
a) Citizens witnessing misconduct by a police officer shall be able to send a report to the Minster of Justice, their Deputy or a Government Prosecutor.

b) The report must include the name, the rank, the allegations and possible evidence.

c) Each report shall be reviewed by an official named in Section 2a.


2. Possible proceedures
a) Answering a report, the Minister, their Deputy or a Prosecutor may
i) give legal advice to the citizen,
ii) request futher information or evidence,
iii) acknowledge the report and insure that measures will be taken,
iv) classify the given evidence or information as insufficient.


b) The citizen may request revision within 48 hours after the response by another
listed official.
i) If the opinions are the same, the verdict is final.
ii) If the opinions differ, each official must present their arguments to the Minister of Justice, who will
have the final say.
iii) If the Minister of Justice is among the officials, a third official within the MoJ will conclude the verdict. This does not include members of the police force.
iv) if no third party is available, the Minister's verdict predominates any other.


c) The reports are not open to the police force. Officers may be informed of number and content of pending reports and investigations against them on request. Additionally, the Chief of Police may request this information for every police employee; they may not distribute them among other officers.

3. Consequences for police officers
a) If a report is classified as relevant, an investigation against the officer shall be conducted. The police officer shall be given access to the full report and the ability to defend themself.

b) If an officer is found guilty of
i) Assault,
ii) Threats of Harm,
iii) Trespassing,

by verdict of an official, they shall be punished in
accordance with the Criminal Code.

c) The officer may be removed from duty and faced with a trial in court, if the investigation reveals significant charges. The Chief of Police must be informed of this.

4. Enactment
This act shall come into effect immediately upon passage.
