Fix Loopholes in the NCCA​

Preamble: Given the current state of certain active cases, as well as ignored precedent, it is clear that fixes need to be made to ensure the law is being upheld as intended.

1. Amendment
(a) Section 5, subsection d of the New Criminal Code Act shall be amended as follows:
(i) (iii) A person commits an offense if the person:
(1) Breaking property that they do not own and are not a member of; or
(2) Killing an animal on a property that they do not own and are not a member of; or
(3) Fires a projectile through glass on a property that they do not own and are not a member of.


(b) Section 6, subsection a of the New Criminal Code Act shall be amended as follows:
(i) (iii) A person commits an offense if the person:
(1) physically prevents or attempts to prevent a law enforcement officer from lawfully detaining or arresting an individual, through force, threats, or obstruction; or
(2) uses or attempts to use an AWS device-protected restricted area that the person has access to, to prevent a law enforcement officer from lawfully detaining or arresting an individual.

(c)
Section 6, subsection b of the New Criminal Code Act shall be amended as follows:
(i) (iii) A person commits an offense if the person:
(1) intentionally interferes with or hinders the administration of justice, including but not limited to tampering with evidence, providing false statements, or interfering with the lawful duties of law enforcement or judicial officers; or
(2) enables an individual to resist arrest through use of a person's restricted area AWS device protections.


(d) Section 6, subsection j of the New Criminal Code Act shall be amended as follows:
(i) (iii) A person commits an offense if the person:
(1) is part of an organized group whose primary purpose is the commission of Murder, Assault and Threats of Harm; or
(2) unlawfully uses violence, directly or indirectly, against civilians, noncombatants, or property, to intimidate or coerce governments, populations, or organizations; or
(3) threatens use of violence, directly or indirectly, against civilians, noncombatants, or property to intimidate or coerce governments, populations, or organizations


Enactment: This Act comes into force immediately upon passage
