Increase Citizen Participation and Representation in Government​

Preamble: This bill aims to increase citizen representation in the government of the Azalea Isles by limiting the number of positions an individual can hold. We have plenty of citizens who are worth involving in government; let's provide opportunities for them rather than perpetually empowering sitting Members of Parliament.

1. Short Title
(a) This bill shall be referred to as the "Representation in Government Act".
(b) This bill was authored by Lysander Lyon.

2. Reasons
(a) We have a great breadth of talents across our citizenry to tap into, with specialists across different industries and areas. Despite this, it has historically proven difficult for aspiring Azaleans to gain recognition and advance through the ranks when one individual holds four, five, or more positions.

3. Position Limits
(a) No individual may hold more than three positions, as defined in Section 4 of this bill, within the Azalean government.
(i) Individuals' ability to hold positions shall also be limited in accordance with the position’s requirements. A Member of Parliament with no other positions is not authorized to assume the position of Justice of the Supreme Court, because the position requires an individual not be in Parliament.
(b) An individual may be authorized to hold a fourth position if a supermajority (2/3) of Parliament votes to approve them for a specific position.
(i) This cannot be a blanket authorization for any fourth position, but must be for a specific position.
(ii) Receiving authorization to hold a fourth position does not put the person into that position. For example, receiving a fourth position authorization to become Minister of Commerce does not mean the individual then becomes Minister of Commerce. The individual must then be successfully confirmed through the normal route.


4. Definitions
(a) Any position nominated by the Prime Minister and confirmed by Parliament shall count as a position.
(i) This includes positions like judicial nominations, Minister positions, being on the Board of Governors for the Bank of Azalea, and being on the National Security Committee.
(b) Any position unilaterally appointed by the Prime Minister shall count as a position.
(i) This includes positions like Deputy Prime Minister and Cabinet Advisor (even if the Cabinet Advisor is named something else).
(c) Any position unilaterally appointed by Parliament, or confirmed by Parliament, shall count as a position.
(i) This includes positions like Speaker of Parliament and Deputy Speaker of Parliament, but will not include committee positions, party/coalition leadership positions (like Leader of the Majority), or other positions of a similar nature.

5. Consequences For Violation
(a) If an individual is found to be in violation of this law, they must be notified of their violation and are given one week to resign down to the acceptable threshold, or if at four positions, receive proper authorization.
(b) If an individual fails to achieve this, they are to be fined $100 per day that they remain in violation.
(c) All citizens are granted standing to sue an individual in violation of this act. Courts may order the immediate termination of a position of their choice that an individual in violation of this act holds.
(i) All filing and court fees are to be waived in the event this happens.

Enactment: This Act comes into force immediately upon passage.
