Regulate Government Contracts
Preamble: This bill aims to regulate and provide clear rules and accountability methods for Ministries to follow relating to Government Contracts.
1 - Short Title and Enactment
(1) This bill shall be referred to as the "Government Contracts Act".
(2) This bill was authored by Nanicholls MP.
(3) This bill shall be enacted immediately.
2 - Reasons
(1) This bill will ensure government transfers of money and the details of government contracts are clearly outlined for the public to see.
(2) This bill will improve transparency with government contracts, finances and ministry actions.
3. Government Contracts
(a) A Government Contract can be defined as any agreement between an official government agent and individual(s) or corporation(s).
(i) For the purpose of this bill, Government Contracts will be used to express any agreement between an official government agent and individual(s) or corporation(s) where money is paid or promised to be paid.
(ii) This does not include payments to Ministry staff in excess of their regularly paid salary or grants.
(iii) This bill includes Large Development Zones.
4. Contract Bidding
(a) Ministries shall all have pages on their official discords where the details of a contract are publicly released.
(b) Ministries shall release the information on the potential contract, and leave it open for bidding for at least 48 hours.
(c) Individuals and Corporations are free to bid through private tickets in the Ministry discord, however, all bids must be posted under the contract posting in the Ministry discord.
(d) After at least 48 hours, the Ministry must inform the public, through the contract post, who they have chosen to carry out the work. This post should include a brief description to inform the public why they chose the bid that they did.
(e) The Ministry must then disclose the final form contract to the contract post for the public to see.
(i) This must be kept up to date as to account for any changes or additions made to the contract as work progresses.
5. Sole Sourced Contracts
(a) A Ministry shall never source a contract from only one individual unless after the 48 hour bidding period, only one bid has been made.
(b) For contracts which receive only one bid, and are valued over $50,000, parliament must vote to accept or decline the contract.
Enactment: This Act comes into force immediately upon passage.
