Regulate All Autonomous Weapon Systems​

Preamble: Autonomous Weapon Systems have become a recent issue in the Azalea Isles, and must be properly regulated to ensure the safety of the citizenry.

1. Short Title & Enactment
(a) This bill shall be referred to as the “Autonomous Weapons Control Act”.
(b) This bill was authored by Lysander Lyon.

2. Definitions
(a) Autonomous Weapon System (AWS): Any device or system of devices that acts or may act to harm or kill another player, without a player being the activating force.
(b) Activating force: The force that activates an AWS to engage in defense of an area.
(c) In layman’s terms, this means an AWS is a system that acts in accordance with preset settings or programmed behavior, without the owner taking an action to direct the AWS.
(d) Property Owner: The individual who owns or rents the property in-game.
(e) Property: A plot or subplot that is either owned or rented by a person or entity.

3. Non-Industrial Plot Licensing
(a) For plots of a different type than I (industrial), Property Owners are allowed to apply to the Ministry of Urban Development for an Autonomous Device License (ADL).
(b) In their application for a ADL, a Property Owner should include the following information:
(i) What classification of ADL the Property Owner is applying for.
(ii) What plot the ADL is for.
(iii) What is the general purpose of the ADL.
(iv) What mode the Property Owner intends to keep the device(s) on.
(v) If an application does not completely list all four requirements, it should be denied.

(c) The Ministry of Urban Development shall review the application to ensure it meets the proper requirements outlined in Section 3b’s subsections, and the respective requirements for the requested classification in Section 4.
(d) The Ministry of Urban Development shall be responsible for maintaining a public list of the plots with a valid ADL, and shall be responsible for collecting the proper registration fee and monthly fee from Property Owners with an ADL.
(i) The monthly fee shall be applied in accordance with calendar months, not thirty day periods.
(ii) Failure to pay the monthly fee by the end of the third calendar day of the month shall result in the temporary suspension of a property’s ADL. The ADL may be reactivated if the monthly payment is made by the end of the 7th calendar day for that month. Failure to pay by the end of the 7th day shall result in the cancellation of the license, requiring new registration.
(iii) Property Owners on LOA shall be exempted from this cancellation, but are expected to pay all accumulated payments within three days of the end of their leave.

(e) ADLs shall not be cross-transferrable to rental regions on a plot. Each rental zone will be counted as a separate property, unless also owned by the Property Owner of the plot itself.

4. Autonomous Device License Classifications and Requirements
(a) A Class 1 ADL allows the Property Owner to place up to one AWS device on the property.
(i) The device may only be a Bow Turret or an Advanced Bow Turret.
(ii) The device must be set to either Mob Mode or Peacekeeper Mode.
(iii) The Property Owner may not have committed a crime of any kind within the last two weeks, or violation within the last week.
(iv) The registration fee shall be $500, with a monthly fee of $250.

(b) A Class 2 ADL allows the Property Owner to place up to three AWS devices on the property.
(i) The devices may only be Bow Turrets or Advanced Bow Turrets.
(ii) The devices must be set to either Mob Mode or Peacekeeper Mode if they are monitoring a publicly accessible space.
(iii) If the devices are monitoring a clearly marked restricted area the public does not have access to, they may be set to PVP Mode. The devices should properly exempt employees or approved visitors/individuals with access to the area.
(iv) The Property Owner may not have committed a crime of any kind within the last thirty days, or violation within the last two weeks.
(v) The registration fee shall be $1,000, with a monthly fee of $500.

(c) A Class 3 ADL allows the Property Owner to place up to four AWS devices on the property.
(i) The devices may be Bow Turrets, Advanced Bow Turrets, or Laser Turrets.
(ii) The devices must be set to either Mob Mode or Peacekeeper Mode if they are monitoring a publicly accessible space.
(iii) If the devices are monitoring a clearly marked restricted area the public does not have access to, they may be set to PVP Mode. The devices should properly exempt employees or approved visitors/individuals with access to the area.
(iv) The Property Owner may not have committed a crime of any kind within the last six weeks, or violation within the last three weeks.
(v) The registration fee shall be $2,500, with a monthly fee of $1,500.

(d) Any AWS device not listed as being accessible through an Autonomous Device License shall be prohibited and may not be placed on a property.
(e) The Ministry of Urban Development may deny a license application for any violation committed by the Property Owner within the last thirty days, at the Ministry’s complete discretion.

5. ADL Rules and Regulations
(a) Committing a crime of any kind invalidates all ADLs a Property Owner holds. They shall not be entitled to a refund of any kind, and will immediately lose their ADLs.
(i) The Ministry of Justice shall be responsible for coordinating with the Ministry of Urban Development to notify them if any Property Owners on the public list of valid ADLs commit a crime.
(b) Any property, including rentals, with an AWS device being used in a publicly accessible space must display signs at each public entrance to the property informing the public that AWS devices are active on the property.
(i) Failure to do so shall be known as “Failure To Provide Notice” with the proper penalty outlined in Section 8b.
(c) If there are no AWS devices active in public spaces, but there are AWS devices being used to guard restricted areas, the property, including rentals, must have signs notifying the public of those restricted areas.
(i) Failure to do so shall be known as “Failure To Provide Notice” with the proper penalty outlined in Section 8b.
(d) AWS devices may never monitor or affect areas outside of the registered plot (or rental), including local sidewalks or connecting plots/rentals owned by another individual, without permission.
(i) Failure to abide by this rule shall be known as “Failure to Respect Property Boundaries” with the proper penalty outlined in Section 8c.
(e) AWS devices may not be set to target or exclude specific individuals, but must enforce uniform peacekeeping or restricted area rules, with the exception of allowances for employees or permitted individuals within restricted areas.

6. Industrial Plot Rules and Regulations
(a) Industrial Property Owners are not required to apply for an ADL if they wish to put AWS devices on their industrial plots, but must for other plot types.
(b) Industrial plots, including rentals, must display signs at any publicly accessible entrance to the property to inform the public that AWS devices are active on the property, if AWS devices are placed in publicly accessible spaces.
(i) Failure to do so shall be known as “Failure To Provide Notice” with the proper penalty outlined in Section 8b.
(c) Industrial plots, including rentals, must display signs at any restricted areas, notifying the public that the area is restricted, if AWS devices are being used to protect those areas.
(i) Failure to do so shall be known as “Failure To Provide Notice” with the proper penalty outlined in Section 8b.
(d) AWS devices may never monitor or affect areas outside of the registered plot, including local sidewalks or connecting plots/rentals owned by another individual, without permission.
(i) Failure to abide by this rule shall be known as “Failure to Respect Property Boundaries” with the proper penalty outlined in Section 8c.
(e) Industrial plots are prohibited from placing AWS devices not allowed to other plots through an ADL.
(i) That means they may only build Bow Turrets, Advanced Bow Turrets, or Laser Turrets, under the regulations of this bill as passed.
(f) AWS devices may not be set to target or exclude specific individuals, but must enforce uniform peacekeeping or restricted area rules, with the exception of allowances for employees or permitted individuals within restricted areas.

7. Liability
(a) The Property Owner of a plot or rental region shall be responsible for all violations or crimes of AWS devices placed on that plot or rental region.
(b) If a plot or rental region does not have the properly displayed signs as required by Sections 4b, 4c, 5b, and 5c, or if the AWS device is improperly set to PVP Mode, AWS device kills shall be counted as Murder, with the Property Owner liable for the associated criminal penalty.
(i) This may be reported to the Ministry of Justice with proper evidence, who will then determine whether enough evidence is present to determine guilt.
(c) Any additional crimes an AWS may be responsible for, such as Mass Murder or Assault, shall also hold the Property Owner liable for the associated penalties.
(i) These crimes may be reported to the Ministry of Justice with proper evidence, who will then determine whether enough evidence is present to determine guilt.
(d) These crimes are voided as reasonable self defense if the victim was trespassing in a properly labeled restricted area, or if the victim engaged in a fight with another individual while a peacekeeper AWS device was active in the public area with proper labeling.

8. Violations
(a) Unauthorized AWS Device
(i) This violation occurs when a non-industrial plot or rental region has an AWS device without an active Autonomous Device License.
(ii) If the device is engaged in active harm, the Ministry of Urban Development may enter the property to disable and confiscate the device. Otherwise, the Ministry of Urban Development should seek an AWS warrant from the Judiciary to get permission to search the property and confiscate AWS devices.
(iii) The Property Owner must be notified via /mail in-game if the Ministry of Urban Development enters to disable the device, or finds and confiscates a device via warrant.
(iv) The Property Owner shall be subject to a fine of $500 if it is a Class 1 or 2 AWS device (currently Bow Turret or Advanced Bow Turret), $1,000 if it is a Class 3-only AWS device (currently Laser Turret), and $2,500 if it is a prohibited AWS device (such as an Artillery Device, currently).


(b) Failure To Provide Notice
(i) This violation occurs when a plot or rental region has AWS devices active in a publicly accessible space, without properly displayed signs at all public entrances; or when a plot or rental region has AWS devices protecting a restricted area, without properly displayed signage defining the area as restricted.
(ii) The Property Owner shall be notified and given 72 hours to fix the issue. If the issue is not resolved at the end of the 72 hours, the Property Owner shall be subject to a fine of $1,000, informed of where the violation has occurred, and be given a period of 72 hours to remedy the issue, before being subject to another violation.
(iii) If the issue is not remedied, the second violation shall have its fines doubled (but only if it is the same initial issue that earned the first violation), with another 72 hour period to remedy the issue.
(iv) If the violation is still not fixed, the fines shall be doubled again, and the individual shall lose their ADL license for the plot or rental region.
(v) Secondary and tertiary violations are prohibited if the Property Owner is on a Leave of Absence.


(c) Failure To Respect Property Boundaries
(i) This violation occurs when a plot or rental region’s AWS device has an effect range outside of the property’s boundaries, meaning government-owned property or a different player’s rental region or plot are affected.
(ii) The Property Owner will be notified and given 72 hours to adjust the device placement, or to submit evidence of being authorized to have their device’s range extend onto the other players’ property. If the device still affects other players’, or the government’s, property at the end of the 72 hour period, the Property Owner shall be fined $1,000, and be given another 72 hours to remedy the issue before being subject to another violation.
(iii) If the issue is not remedied, the second violation shall have its fines doubled (but only if it is the same initial issue that earned the first violation), with another 72 hour period to remedy the issue.
(iv) If the violation is still not fixed, the fines shall be doubled again, and the individual shall lose their ADL license for the plot or rental region.
(v) Secondary and tertiary violations are prohibited if the Property Owner is on a Leave of Absence.


(d) Discriminatory Targeting
(i) This violation occurs when a plot or rental region’s public area AWS device is set to only target or monitor specific individuals, although proper employee exemptions are allowed. This does not apply to devices protecting restricted areas.
(ii) The Property Owner will be notified and given 72 hours to respond to an accusation of Discriminatory Targeting, before being subject to a fine of $500.
(iii) Repeated violations shall result in the loss of the property’s ADL license at the discretion of the Ministry of Urban Development.


(e) The authority to enforce all fines, and make the final administrative determination on all violations is granted to the Ministry of Urban Development.
(i) This does not preclude judicial review, where an individual would seek to prove they did not commit a violation.
(f) The authority to remove a plot or rental region’s ADL in accordance with the above violation regulations is granted to the Ministry of Urban Development.

9. Crimes
(a) As outlined in the liability section, Property Owners shall be held criminally responsible for any murder or crimes committed by AWS devices on their property, so long as the AWS device is not defending a properly labeled restricted area or engaging in peacekeeper mode in a properly labeled public area. The Ministry of Justice shall be empowered to enforce the crimes listed in this section, not precluding judicial review.
(b) Section 4 of the New Criminal Code Act shall be amended to include the following:
(k) AWS Abuse
(i) Offense Type: Misdemeanor
(ii) Penalty: 10 minutes jail time, and a $500 fine
(iii) A person commits an offense if the person:
(1) is the Property Owner of a plot or rental region where an AWS device improperly kills or harms a player
(2) with Property Owner defined as the in-game listed tenant for rental regions or the listed plot owner for plots
(3) and with AWS device defined by the Autonomous Weapons Control Act

(c) Section 10 of the New Criminal Code Act shall be amended to include the following:
(d) Prohibited Device Possession
(i) Offense Type: Misdemeanor
(ii) Penalty: 15 minutes jail time, and a $1,500 fine
(iii) A person commits an offense if the person:

(1) is the Property owner of a plot or rental region where a prohibited AWS device exists
(2) with Property Owner defined as the in-game listed tenant for rental regions or the listed plot owner for plots
(3) with prohibited AWS device defined as any AWS device not accessible through an Autonomous Device License

(4) and with AWS device defined by the Autonomous Weapons Control Act

10. Industrial Regulation Act Amendment
(a) Section 3(a)viii shall be stricken from the Industrial Regulation Act.

11. AWS Warrants
(a) In order to get an AWS Warrant, the Ministry of Urban Development, or the Ministry of Justice on their behalf, shall follow the following filing structure:

I, [Ministry of Urban Development’s Counsel’s Name], hereby affirm that the allegations in the request AND all subsequent statements made in court are true and correct to the best of the government’s knowledge, information, and belief and that any falsehoods may bring the penalty of perjury.

(b) Any District Court Judge may review the request, and shall choose to grant it or deny it on the basis of probable cause (reasonable belief).
(i) If no District Court Judge is available; responds to the warrant request within 72 hours; or if the District Court does not legally exist, any higher-level judicial officer, such as a Supreme Court Justice, may review the warrant.
(c) If the warrant is granted, the Ministry of Urban Development shall not only have permission to search the property, but shall also have permission to confiscate any unauthorized AWS devices found on the property.
(d) The Ministry of Urban Development may not file a warrant against multiple Property Owners at once, but may file a warrant against multiple properties of one Property Owner at once. However, their request must then fulfill probable cause for all properties.

12. Corporate Ownership
(a) In the event the Property Owner of a plot or rental region is a company, all fees shall be directed to the company itself, while all warnings, communications, and criminal time shall be directed to the highest executive of the company (the in-game owner, if there is no easily determined CEO or President of the company).

Enactment: This Act comes into force immediately upon passage.
