Type: Amendment to the Parliamentary Establishment and Standards Act

A
BILL
TO
AMEND THE PESA

Preamble: Once a MP is elected into parliament, there is currently no way to remove them from office should they fail to meet the standards expected of them.

1. The following section is to be added to the Parliamentary Establishment & Standards Act:

14. Recall Process
(a) In the event that an MP believes that another MP should be recalled, they can motion for a Recall. The Speaker shall put the recall up for a vote for 48 hours or until a majority is reached with the options of aye (removal), nay (no removal), or abstain.
(b) Quorum for a recall will follow the quorum established in the standing orders of the parliament.
(c) The Speaker is not to vote until there is a tie. In the event of a tie, the Speaker can cast the deciding vote.
(d) MPs being recalled are allowed to vote, even if suspended.

2. Section 2(d) shall be removed from the Parliamentary Establishment & Standards Act.

Enactment: This Act is to take effect immediately after passage.
