Updated Criminal Contests Act
Preamble: This amendment sets to update and streamline contest procedures
1. Naming and Authors
(a) This bill shall be referred to as the “Updated Criminal Contests Act”
(b) This bill was authored by Catt Lalande and Hugebob23456
(c) This bill amends the New Criminal Contests Act
2. Amendments
(a) Section 12 (a) of the New Criminal Code Act shall be amended as follows:
(i) If an individual states upon arrest that they wish to contest, is informed of how to do so, and then fails to open a ticket to contest over the followingthree minutes 24 hours after they were charged, the individual waives their right to contest.
(ii) A suspect is required to pay all applicable fines and serve their jail sentence/post bail in order to be eligible to contest charges regardless of supposed fault.
(ii) (iii) Suspects have 24 hours, from the time they open their ticket to contest, to provide their refutation of the charges against them, including any evidence or proof that supports the argument they make.
(iii) (iv) If a suspect has a resisting arrest charge, they are deemed a flight risk and waive their right to contest.
(iv) (v) If a suspect is found to be guilty of a crime, while still having a ticket open to contest another crime, the contest shall be invalidated and the suspect will be guilty of the crime they were seeking to contest.
(v) (vi) The Ministry of Justice shall review the contest ticket and the evidence / arguments provided. The ministry has 7 days to return a verdict on the contest, if they fail to respond within the allotted time, the contest is automatically approved.
(vi) (vii) If the Ministry of Justice determines that guilt beyond a reasonable doubt does not exist, the charges shall be dropped. All fines and bail must be reimbursed to the individual within 24 hours of their charges being dropped. If no bail was paid and the individual served out the sentence, they are eligible for up to 60 minutes worth of bail costs. If the Ministry believes guilt beyond a reasonable doubt does exist, the individual shall be charged with the contested crime.
(vii) (ix) If the suspect believes this procedure was violated, or that guilt beyond a reasonable doubt does not exist, the suspect may file a lawsuit in court to make their case about that belief.
