Preamble: This amendment addresses how the Mayor-Member of Parliament office is filled, during parliamentary dissolution and in scenarios where multiple seats are allocated or a tie occurs.
1. Short Title
(a) This bill shall be referred to as the “Local Representation Clarification Amendment”.
(b) This bill was authored by Lysander Lyon.
2. Clarifications
(a) Section 2 shall be replaced with the following:
2. Electoral Districts
(a) The candidate with the highest vote total in a district shall be elected as that district’s Mayor-Member of Parliament, and hold unique local authority in the district.
(i) This includes scenarios where more than one parliamentary seat is assigned to a district.
(b) This shall not apply to at-large districts.
(c) If a tie should ever occur for the highest vote total, a runoff election between the candidates that tied shall be started in the 72 hours following the end of the last election.
(b) Section 4(e) shall be added, to state: “Following the dissolution of Parliament, Mayor-Members of Parliament are removed from Parliament like any normal Member of Parliament. However, they retain their position, authority, and powers as Mayor for the district until a new Mayor-Member of Parliament is elected for the district.
(c) Section 7(h) shall have the comma after development replaced with a period, to state: “Owners may also be fined for lack of development.”
Enactment: This Act comes into force immediately upon its passage.
