White Shadow (Rosechan), Plaintiff
Benjamin Higgins (BrokenCalculator), Plaintiff
v.
Skibidi Fart, Defendant
Civil Complaint:
On May 25th, the Plaintiff White Shadow returned to his farm with a horse. White and Benjamin were excited to acquire this horse, and were going to share ownership and caretaking responsibilities. White momentarily logged off from the server, and Benjamin was not around; upon returning, he found that the horse was missing. The Defendant, Skibidi Fart, told White Shadow and the other Plaintiff, Benjamin Higgins, that he would require $1,000 from each of them before he would give them the horse back. The Plaintiffs each paid $950 to the Defendant, who then provided the pair with the general location of the horse. Theft of property and extortion in demand for its return is not acceptable in the Isles, and while we may not pursue criminal charges, there are clear damages to the Plaintiffs.
Parties:
Plaintiff - White Shadow, represented by Lysander Lyon
Plaintiff - Benjamin Higgins, represented by Lysander Lyon
Defendant - Skibidi Fart
Factual Allegations:
1) White Shadow brought the horse to her farm, as shown in Exhibit A.
2) Skibidi Fart knew where the horse was after it was taken from the farm, as evidenced by his leading the Plaintiffs to the horse after they paid him, shown in Exhibit B. He also knew its location, as he was able to check to see if it was still there in Exhibit D.
3) The Plaintiffs both paid him $950, as evidenced by the payment shown in Exhibit B and in the negotiation from Exhibit C.
Legal Claims:
1) The "fees" paid to recover the horse, as well as the bus tickets, are expenses the Plaintiffs would not otherwise have had to make.
2) The Plaintiffs may not be able to levy criminal charges, but there are clear monetary damages incurred by the Plaintiffs due to the extortionary payments required and the bus tickets required.
3) The Plaintiffs only need to prove by a preponderance of the evidence that the Defendant is responsible for what was outlined in this case.
Prayer For Relief:
1) Compensatory damages in the amount of $1,920, to cover $950 and one $10 bus ticket for each Plaintiff.
2) Punitive damages in the amount of $2,000, to punish the Defendant's apparent larceny and extortion.
3) Special damages in the amount of $1,000, as the legal fees would not have occurred without the Defendant's actions.
Verification:
I, Lysander Lyon, hereby affirm that the allegations in the complaint AND all subsequent statements made in court are true and correct to the best of the plaintiff's knowledge, information, and belief and that any falsehoods may bring the penalty of perjury.
Class Verification
Your Honor, this class should clearly be certified. Both individuals were harmed in an identical way. Their property was stolen, and they were extorted for money and forced to search for it by the Defendant. They have been injured identically, and as such, share a common characteristic worthy of class certification.
