Recall Act
Preamble: This bill aims to allow Azaleans the opportunity to recall Members of Parliament.

1. Short Title and Enactment
(a) This bill shall be referred to as the "Recall Act".
(b) This bill was authored by Nanicholls MP.
(c) This bill shall be enacted immediately.

2. Reasons
(a) This bill will ensure Members of Parliament remain accountable to voters during their term in office.
(b) This bill will enhance citizen participation in democracy.

3. Citizen Led Recall
(a) Any citizen of Azalea with over 3 hours of playtime, and 1 hour of playtime in the last month may petition for the recall of a Member of Parliament.
(i) They may make this request for Recall under the “Petitions and Referendums" section of the forums.
(ii) They must follow all the criteria laid out in this bill when filing a Petition for Recall.
(b) After filing a Petition for Recall under the “Petitions and Referendums" section of the forums, the citizen must await approval from a justice that the petition complies with the criteria laid out in this bill.
(c) After a Justice has confirmed that the petition meets all criteria, the citizen has 48 hours to receive signatures on the petition. The citizen can follow any of the following paths for receiving signatures:
(i) A recall and removal petition: If a citizen can receive 25% more signatures than the total number of voters in the previous election, the member of parliament will be recalled and removed from office immediately. A by-election will be held for the seat immediately and the removed member is barred from running in it.
  1. No citizen who has joined the server in the last 7 days is eligible to sign a recall and removal petition.
(ii) A recall election petition: If a citizen can receive the same number of signatures as the number of votes total in the last election, a by-election for the seat will be immediately called. The member of parliament being recalled will be allowed to run in the by-election.
  1. No citizen who has joined the server in the last 7 days is eligible to sign a recall and removal petition.
(iii) A recall request petition: If a citizen can receive the same number of signatures as the number of votes the Member of Parliament got in the last election, the recall petition will be sent to Parliament for a vote. A two-thirds majority is then required for removal from office and the member of parliament being recalled will be allowed to run in the by-election for the seat.
  1. No citizen who has joined the server in the last 7 days is eligible to sign a recall and removal petition.

4. Recall Petition Criteria
(a) Any citizen of Azalea with over 3 hours of playtime, and 1 hour of playtime in the last month may petition for the recall of a Member of Parliament.
(b) Citizens may file a Petition for Recall under the “Petitions and Referendums” section of the forums.
(c) Included in this Petition for Recall must be the following:
(i) Title: “Petition for Recall”
(ii) Target: Member of Parliament Name
(iii) Reason: Short Paragraph on why you believe this member should be recalled
(iv) Type of Recall: Specify the type of recall this will be (Recall and Removal, Recall Election, Recall Request )
(d) The citizen must then await approval from a justice that the petition complies with the criteria laid out in this bill.
(e) After a Justice has confirmed that the petition meets all criteria, the citizen has 48 hours to receive signatures on the petition.
(i) No individual who has been a citizen for less than 7 days may sign the recall petition.

5. Recall By-Elections
(a) If a recall petition is successful, and a by-election to fill the seat is required, the by-election candidacy registration period must open immediately.
(b) The by-election candidacy registration period must remain open for 48 hours, with a 48-hour election period immediately following.

Enactment: This Act comes into force immediately upon passage.
